We attend to all the legal requirements and liaise with your financier and co-ordinate the settlement process.

If you’re considering transferring property to a family member as a gift, or wish to sell a property to a family member, We can prepare the necessary documentation and guide you through the whole process to ensure the transaction is completed as smoothly as possible.

If you wish to sell a property, or have negotiated to purchase property directly from a family member, you may require a Contract and Form 1 (“cooling-off forms”).

We can assist in the preparation of the Contract accurately reflect what has been agreed between the Vendor(s) and Purchaser(s) including the drafting of special conditions, order the necessary government searches on your behalf and assist in the preparation of the  Form 1’s ensuring that all information required by law has been disclosed to the Purchaser.

Looking at transferring a property a Spouse or De-facto partner?

We can prepare the necessary documentation to transfer a property between a married couple, a couple in a De-facto relationship, or to comply with court orders and property settlement agreements in the event of a separation or divorce.

We can deal with all aspects of the transfer and liaise with you, your Lender, Lands Titles Office and Stamp Duties Office to ensure a complete, legally binding and professional settlement. You will also be advised on any Stamp Duty implications and costs you may incur.

If you intend to buy or sell property without engaging a Real Estate Agent we can undertake the preparation of the contract and assist in the preparation of the Form 1 on your behalf. You negotiate the contractual arrangements and we document them.

The Form 1 is the basis of the formal statement by the vendor about certain details relating to the property being conveyed. It is required under section 7 of the Land and Business (Sale and Conveyancing) Act 1994 (SA). Keystone Conveyancer SA can assist in the preparation of the Form 1, we have available to us a dedicated team that will ensure a the Form 1 will be prepared in a quick and timely manner.

We can assist in preparing the necessary application to note a change of name or death on a certificate of title.

Should your property be mortgaged, we will also liaise with your Lender so the application can be lodged at the Lands Titles Office for issue of a new title in the correct name.
